What are the general rules?

Answer.

Over many years, the courts have identified charitable purposes as the following:

  • the relief of poverty;
  • the advancement of education;
  • the advancement of religion; or
  • other purposes beneficial to the community as a whole that the courts have identified as charitable.

In addition to the tests which establish the various categories of charitable purpose, the courts have consistently decided that charity cannot be carried on in a 'political' way.
